Canadians working in the U.S. and Obtaining a TN Visa

THE NAFTA AGREEMENT & CHAPTER 16

The NAFTA agreement is a lenghy and complex treaty between Canada, the U.S. and Mexico. to simplify things, however, we are mainly concerned with Chapter 16 of the agreement titled "Temporary Entry for Business Persons". Chapter 16 sets the rules that apply to workers seeking entry into the other country regarding employment. It would be a good idea for employers to obtain a copy of this document and keep it handy, however, if your a worker interested in obtaining a NAFTA Visa, I wouldn't stress out too much and please don't worry about memorizing this document - it won't be necessary.

Perhaps the most important section of Chapter 16 is the schedule defining eligible employment categories or Schedule II. This section lists the categories and educational requirements. There is very little flexibility here. Of particular interest to Geographers or employers seeking to hire people skilled in GIS is the category Geographer. Please note, there may be some confusion with this category as I've seen schedules and other legal documents that only list an occupational category Urban Planner/Geographer. Be careful here, and make sure that you fall into this category. There may be NAFTA border officials that might question the category "Geographer" so be prepared to state that the occupation is actually listed as Urban Planner/Geographer. It is my feeling that anyone with a Bachelors degree in geography can qualify under this category, regardless of your experience in urban planning!
