Canadians working in the U.S. and Obtaining a TN VisaBy Glenn LethamSo, What is a TN Visa? Workers using a TN Visa are also known as Free Trade Professionals, NAFTA workers, TN or TN-1 professionals. The TN work permit designation is made possible by the North American Free Trade Agreement (NAFTA) and pertain to Canadian and Mexican citizen temporary visitors, treaty traders, investors, temporary workers and professionals (Grasmick, p. 147). The provisions of this agreement are similar to those set out in the original Canada-US free trade agreement of 1989. Under the latest NAFTA agreement, individuals obtaining a Free Trade Professional designation are known as TN-1 or Trade NAFTA Professionals (TN-2 for Mexicans). Canadians must meet the following requirements to be eligible for a TN: - must be Canadian citizen (passport necessary) - intended job must qualify under Schedule 2 of Chapter 16 NAFTA Agreement Please note, other categories that may provide eligible individuals skilled in GIS include; Geochemist, Geologist, Forester, Soil scientist, Statistician, and scientific technologist. Important, if you are planning on hiring a person with a degree in Geology to fill a GIS position, it is recommended that you tailor your Visa petition to state that you wish to hire a Geologist and the potential employees is skilled and educated in Geology. Trying to petition someone with a degree in Geology for a job classified as a Geographer will definitely lead to problems and likely a denied petition.
